{"id":11864,"date":"2013-11-05T21:12:54","date_gmt":"2013-11-05T21:12:54","guid":{"rendered":"http:\/\/asile.ch\/wp\/?p=11864"},"modified":"2021-08-26T14:09:45","modified_gmt":"2021-08-26T12:09:45","slug":"les-accords-de-dublin-explique-par-ecre","status":"publish","type":"post","link":"https:\/\/asile.ch\/de\/2013\/11\/05\/les-accords-de-dublin-explique-par-ecre\/","title":{"rendered":"Les accords de Dublin expliqu\u00e9s par ECRE"},"content":{"rendered":"<h3>Le European Council on Refugees and Exiles (<a href=\"http:\/\/www.ecre.org\/\" target=\"_blank\" rel=\"noopener\">ECRE<\/a>) a publi\u00e9, sur son site internet, une explication du <abbr class='c2c-text-hover' title='En vertu du R\u00e8glement Dublin, chaque demande d\u2019asile d\u00e9pos\u00e9e sur le territoire d\u2019un \u00c9tat Dublin n\u2019est examin\u00e9e que par un seul \u00c9tat membre.'>R\u00e8glement Dublin<\/abbr>.<\/h3>\n<p>L&rsquo;ECRE r\u00e9pond, sur son site, aux <a href=\"http:\/\/www.ecre.org\/topics\/areas-of-work\/protection-in-europe\/10-dublin-regulation.html\" target=\"_blank\" rel=\"noopener\">interrogations suivantes<\/a> (en anglais):<\/p>\n<ul>\n<li><strong>Qu&rsquo;est-ce que Dublin?<\/strong><\/li>\n<li><strong>Comment Dublin \u00a0marche-t-il en pratique?<\/strong><\/li>\n<li><strong>Qu&rsquo;est-ce qui est aujourd&rsquo;hui en train de se passer en Europe?<\/strong><\/li>\n<\/ul>\n<p><strong>Elle ajoute en outre sa position sur les accords:<\/strong><\/p>\n<div class=\"c-block--box c-block--default\"><div class=\"c-block--box-inner\"><\/p>\n<ul>\n<li>The Dublin system fails to ensure that refugees are protected, and wrongly assumes that there are equal standards of protection across Europe;<\/li>\n<li>States must adhere to their obligations not to send asylum seekers to a Member State where there is a risk of a violation of their fundamental rights;<\/li>\n<li>ECRE recommends that Member States apply the sovereignty clause in situations where the allocation of responsibility would result in transfers to Member States that are not compliant with the standards in the Reception Conditions Directive, Asylum Procedures Directive and Qualification Directive;<\/li>\n<li>The Dublin Regulation should provide for automatic suspensive effect of appeals: applicants must have the right to remain in the country where they have requested asylum while their appeal against a transfer to the first country they entered is being examined;<\/li>\n<li>The definition of family should be extended, and asylum seekers should be able to join any family member lawfully present in the EU;<\/li>\n<li>ECRE calls for Member States to apply the current Dublin Regulation in a protection sensitive manner. Ultimately however the Dublin Regulation should be abolished and replaced by a more humane and equitable system that considers the connections between individual asylum seekers and particular Member States.<\/li>\n<\/ul>\n<p><\/div><\/div>\n<p><strong>Un texte, qui date de 2008, publi\u00e9 par <a href=\"http:\/\/www.lacimade.org\/\" target=\"_blank\" rel=\"noopener\">La Cimade<\/a> est aussi toujours d&rsquo;actualit\u00e9 pour comprendre le syst\u00e8me Dublin.
