Chypre, la Gr\u00e8ce, l’Italie, Malte et l’Espagne ont r\u00e9dig\u00e9 une proposition commune dans le cadre de la r\u00e9forme de Dublin. Ces pays aspirent notamment \u00e0 une meilleure r\u00e9partition des r\u00e9fugi\u00e9s entre les pays europ\u00e9ens et un assouplissement du regroupement familial. En 13 points, ils am\u00e8nent des propositions face aux \u00e9volution <\/span>des accords<\/span> de Dublin envisag\u00e9s par l’Union europ\u00e9enne. Tout l’enjeu r\u00e9side \u00e0 trouver un compromis d’ici au mois de juin. <\/span><\/p>\n

Selon l’analyse du journal Politico<\/em><\/a>, cette prise de position importante est \u00e9mise en r\u00e9ponse aux pays de Visegrad (Hongrie, R\u00e9publique Tch\u00e8que, Pologne et Slovaquie) qui ont jusqu’ici contr\u00e9 tous les efforts de Bruxelles pour forcer les pays de l’Union \u00e0 accepter des requ\u00e9rant.e.s d’asile et \u00e0 amener des restrictions aux renvois vers le premier pays travers\u00e9 par les personnes migrantes. Or, une des r\u00e9formes \u00e9mises par la Proposition bulgare (soutenue par des pays comme l’Allemagne et la Su\u00e8de) serait d’\u00e9tablir une politique du quota de r\u00e9partition en cas de nouvelle arriv\u00e9e importante de personnes migrantes. Autre enjeu majeure que cherche \u00e0 contrer la prise de position de ces cinq pays du Sud de l’Europe est la Proposition bulgare de faire porter la responsabilit\u00e9 de la demande d’asile pendant 10 ans au premier pays d’arriv\u00e9e. Cette pratique ram\u00e8nerait, selon les 5 pays m\u00e9diterran\u00e9ens, \u00e0 leur faire porter le poids de la gestion des migrations. Le Conseil europ\u00e9en s’\u00e9tait fix\u00e9 comme d\u00e9lai le mois de juin pour trouver un accord sur les r\u00e9formes \u00e0 entamer.<\/p>\n

Approaching the self-imposed deadline<\/a> of the European Council meeting in June 2018 for reaching a Council position on the reform of the Dublin system a group of 5 Southern EU Member States are rocking the EU Boat in a joint non paper<\/a>.<\/p>\n

The position paper lists a number of red lines for the countries concerned in the ongoing difficult negotiations on the Council position on the highly controversial reform of the Dublin Regulation. Emphasising the need for a balance between responsibility and solidarity, the group proposes inter alia<\/em> to reduce the time period of State responsibility for an asylum applicant to a maximum of two years instead of the currently proposed 10 years. The latter would, according to an EU diplomat quoted<\/a> by Politico: \u201cresult in the responsibility of asylum and border control to be completely on the shoulders of southern border states.\u201d<\/p>\n

Furthermore the Southern Members argue that their efforts in the area of search and rescue and external border management must but taken into account when calculating their \u201cfair share\u201d and that the pool of persons eligible for relocation from countries under \u201cchallenging circumstances\u201d should be sufficiently large in order to bring meaningful \u201crelief\u201d to systems under pressure. They also reject the inclusion of beneficiaries of international protection within the scope of the Regulation and reject the mandatory application of safe country concepts before determining which Member State is responsible for examining the claim, in particular where they are under high pressure.<\/p>\n

Many of the points advanced in the position paper echo the positions<\/a>\u00a0of the Visegr\u00e1d group, thereby creating an alliance which further complicates the task of the Bulgarian Presidency to broker a compromise in the Council. At the same time, the Hungarian government spearheading the Visegr\u00e1d Group including also Poland, Czech Republic and Slovakia has reiterated at various occasions its opposition to any form of mandatory relocation of asylum seekers across the EU.<\/p>\n

Reaching agreement by June 2018 is further complicated by the uncertain political situation in Italy after the election pending the establishment of a new government. In light of the upcoming European elections in May 2019 the time is running out for the European institutions if an agreement with the European Parliament is to be found before the end of its term.<\/p>\n

With the adoption by the LIBE Committee of a report on the reform of the Dublin system including a permanent and mandatory relocation scheme that would apply regardless of any crisis situation in October 2017 the European Parliament negotiation position is clear.<\/p>\n
