Sans vergogne, la Suisse se f\u00e9licite d\u2019\u00eatre l\u2019un des pays les \u00ab\u2009plus performants du continent pour ce qui est de l\u2019ex\u00e9cution des renvois\u2009\u00bb.<\/p>\n\n\n\n<p>Performance\u2009? Le terme interpelle. Un coup d\u2019\u0153il sur le dernier rapport de la Commission nationale de pr\u00e9vention de la torture (CNPT) nous ram\u00e8ne aux r\u00e9alit\u00e9s concr\u00e8tes des renvois sous contrainte (points 18, 19 et 35) <span class=\"footnote_referrer\"><a role=\"button\" tabindex=\"0\" onclick=\"footnote_moveToReference_96210_1('footnote_plugin_reference_96210_1_3');\" onkeypress=\"footnote_moveToReference_96210_1('footnote_plugin_reference_96210_1_3');\" ><sup id=\"footnote_plugin_tooltip_96210_1_3\" class=\"footnote_plugin_tooltip_text\">[3]<\/sup><\/a><span id=\"footnote_plugin_tooltip_text_96210_1_3\" class=\"footnote_tooltip\">CNPT, <a href=\"https:\/\/www.newsd.admin.ch\/newsd\/message\/attachments\/80997.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Rapport relatif au contr\u00f4le des renvois en application du droit des \u00e9trangers, janvier \u00e0 d\u00e9cembre 2022&nbsp;<\/a>(en all.), 03.04.2023.<\/span><\/span><script type=\"text\/javascript\"> jQuery('#footnote_plugin_tooltip_96210_1_3').tooltip({ tip: '#footnote_plugin_tooltip_text_96210_1_3', tipClass: 'footnote_tooltip', effect: 'fade', predelay: 0, fadeInSpeed: 200, delay: 400, fadeOutSpeed: 200, position: 'top center', relative: true, offset: [-7, 0], });<\/script>\u2009: \u00abLa Commission a observ\u00e9 un cas dans lequel environ 45 policiers et polici\u00e8res \u00e9taient pr\u00e9sents pour la prise en charge d&rsquo;une famille de quatre personnes \u00e0 rapatrier [\u2026]. Dans ce m\u00eame cas, la m\u00e8re, enceinte de quatre mois, a \u00e9t\u00e9 menott\u00e9e en pr\u00e9sence de ses enfants pendant la prise en charge. Elle a d\u00fb allaiter avec les menottes, qui ne lui ont pas non plus \u00e9t\u00e9 enlev\u00e9es pendant l&rsquo;examen pratiqu\u00e9 par le m\u00e9decin auquel il a \u00e9t\u00e9 fait appel. [\u2026] De plus, selon l\u2019observateur, la femme a \u00e9t\u00e9 port\u00e9e dans les escaliers de mani\u00e8re inad\u00e9quate par trois, voire quatre policiers et polici\u00e8res, alors qu&rsquo;elle s&rsquo;est plainte \u00e0 plusieurs reprises de douleurs au ventre. [Le rapatriement] a \u00e9t\u00e9 interrompu en raison d&rsquo;une contre-indication m\u00e9dicale pour la m\u00e8re. [\u2026]&nbsp;Le p\u00e8re a \u00e9t\u00e9 renvoy\u00e9 comme pr\u00e9vu, mais d\u00e9sormais s\u00e9par\u00e9 de sa famille].\u00bb<\/p>\n\n\n\n<p>Et ce type de r\u00e9cit ne manque pas. En 2010, un ressortissant nig\u00e9rian en est m\u00eame mort\u2009: il \u00e9tait attach\u00e9 \u00e0 un fauteuil roulant, casqu\u00e9 et portait un filet facial. Depuis, les rapports annuels de la CNPT se suivent et se ressemblent. Chaque ann\u00e9e, elle y d\u00e9nonce des pratiques excessives\u2009: port d\u2019armes et mesures d\u2019entraves disproportionn\u00e9es lors des transports en fourgon cellulaire, puis au sol pendant la pr\u00e9paration du vol, traumatismes provoqu\u00e9s chez les enfants et renvois s\u00e9par\u00e9s des membres de la famille, etc. Chaque ann\u00e9e, elle d\u00e9plore la violence des renvois sous contrainte.<\/p>\n\n\n\n<p>D\u00e9finitivement, la performance est plut\u00f4t \u00e0 chercher du c\u00f4t\u00e9 de la long\u00e9vit\u00e9 de ces violences polici\u00e8res. Sans parler du fait qu\u2019une grande partie des vols sp\u00e9ciaux concernent des renvois Dublin, autrement dit des personnes dont la demande d\u2019asile n\u2019a pas \u00e9t\u00e9 examin\u00e9e. Sans parler du stress et de la retraumatisation engendr\u00e9s par la peur du renvoi pour toutes les personnes concern\u00e9es. Elle est l\u00e0 aussi, la performance, \u00e0 entendre comme exhibition sinistre de la puissance coercitive de l\u2019\u00c9tat, \u00e0 l\u2019attention de celles et ceux qui pr\u00f4nent des politiques migratoires toujours plus restrictives.
